There have been changes in the law that make our experience on both sides of the fence invaluable.  Defendants can now make an offer of judgment in a case. If the injured party refuses but a jury does not award them at least 125% of the offer, the injured party must pay the defendant’s attorneys’ fees incurred from the time of the offer.

For example, if an injured party rejects a $100,000.00 offer a jury must award them at least $125,000.00 in order to avoid the attorneys fees penalty.  This change requires that you be represented by lawyers that can best lay a foundation to successfully counter this significant negotiating advantage provided to defendants.
