What is “Eminent Domain”?

Eminent domain is the power of the government to take private property for public use upon payment of just and adequate compensation.  The initial process involves appraisal of the property’s fair market value and any damages related to the taking as well as negotiation of compensation.  If the property owner is dissatisfied with the offered amount of compensation for the property taken, then a lawsuit condemnation action is filed.
